Plaintiff’s
motion to strike is MOOT. Given that the newly
filed answer is not labeled as an amended answer, the Court orders the original
answer stricken to avoid confusion.
On 6/28/2022,
Plaintiff 2010 East 7th Street, LLC (Plaintiff) filed an unlawful
detainer against Sensu, Inc. (Defendant).
On 9/16/2022,
Plaintiff moved to strike Defendant’s answer on the basis that it was
improperly verified.
In
opposition, Defendant noted that it had since filed an amended answer,
rendering this motion moot. Defendant also noted that it reached out to
Plaintiff’s counsel requesting that the parties stipulate to allow Defendant to
file an amended answer with proper verification, but that Plaintiff’s counsel
was unwilling to do so.
Moving
forward, the Court urges the parties to informally resolve disputes where it is
possible to do so. Given that the newly filed answer is not labeled as an
amended answer, the Court orders the original answer stricken to avoid
confusion.
