Case Number: 22STCV41031    Hearing Date: May 11, 2023    Dept: 17

Superior Court of California

County of Los Angeles

DEPARTMENT 17

TENTATIVE RULING

R.C.

         vs.

DOE DEFENDANT 1

 Case No.:  22STCV41031

 Hearing Date:  May 11, 2023

Plaintiff’s motion for a stay of proceedings is GRANTED.

On 12/30/2022, Plaintiff R.C. (Plaintiff) filed suit against Doe Defendants 1-3, alleging: (1) claim for childhood sexual assault; (2) negligence; (3) negligent hiring, training, supervision, retention; (4) sexual battery; (5) intentional infliction of emotional distress; (6) negligent infliction of emotional distress; and (7) breach of fiduciary duty.

Now, Plaintiff seeks a stay of proceedings.

            The motion is unopposed.

Discussion

Plaintiff seeks a stay of proceedings based on a federal bankruptcy court’s ruling in Adversary Proceeding No. 20-50527 (LSS) ordering cases against the DOE Defendants here stayed until the bankruptcy matter is resolved in Case No. 20-10343 (LSS).

Here, Plaintiff’s motion is procedurally compliant, and meets the criteria warranting a stay. (CRC rule 3.515(b).) This conclusion is reinforced by the lack of any opposition.

Based on the foregoing, Plaintiff’s motion for a stay of proceedings is granted.

It is so ordered.
