Defendant’s motion to compel initial responses to Form Interrogatories is GRANTED. Plaintiff is sanctioned, jointly and severally with counsel, $700.

 

           On 11/21/2023, Plaintiff Roberto Perez (Plaintiff) filed suit against Mireya Perez, David Jorge, and Bank of America, alleging quiet title.

 

           On 5/23/2024, Defendant Mireya Perez (Defendant) moved to compel initial responses to her Form Interrogatories. Defendant also seeks monetary sanctions.

 

           The motion is unopposed.

 

Discussion

          

           On 4/9/2024, Defendant served Plaintiff via e-mail and U.S mail with Form Interrogatories. Despite responses being due on or before 5/14/2024, Plaintiff has not responded nor did Plaintiff oppose this motion.

 

           Having failed to set forth any justification for the failure to respond, Plaintiff is sanctioned, jointly and severally with counsel, $700.00. ($350/hr x 2.)

 

           Based on the foregoing, Defendant’s motion to compel initial responses to Form Interrogatories is granted. Plaintiff is sanctioned, jointly and severally with counsel, $700.

 

It is so ordered.
