Plaintiff’s
motion to compel responses to its Form Interrogatories (Set One), Special
Interrogatories (Set One), RFAs (Set One), and RFPs (Set One) is GRANTED.
Homegoods is sanctioned, jointly and severally with counsel, $1,400 per motion
payable within 30 days.
On
4/4/2024, Plaintiff Consumer Protection Group (Plaintiff), in the public
interest, filed suited against Homegoods, Inc. (Homegoods) and the TJX Companies,
Inc., for violation of Proposition 65.
On
8/29/2024, Plaintiff moved to compel initial responses from Homegoods to the
following discovery: (1) Form Interrogatories (Set One); (2) Special
Interrogatories (Set One); (3) Requests for Admission (RFAs); (4) Requests for
Production (RFPs) (Set One). Plaintiff seeks monetary sanctions in connection
with the motions.
For
ease, the Court has consolidated its analysis into a single ruling.
The
motions are unopposed.
Discussion
On
6/21/2024, Plaintiff served Homegoods with the discovery at issue in this
motion. After granting several extensions, the revised deadline to provide
discovery responses was 8/7/2024. To date, no responses have been filed, and
Homegoods did not oppose this motion.
Based
on the foregoing, Plaintiff’s motion to compel responses to its Form
Interrogatories (Set One), Special Interrogatories (Set One), RFAs (Set One),
and RFPs (Set One) is granted. Homegoods is sanctioned, jointly and severally
with counsel, $1,400 per motion. ($350/hr x 4 hrs.)
