TENTATIVE RULING

            Defendant’s demurrer is MOOT.

            On 7/10/2024, Plaintiff Steven Kahana (Plaintiff) filed suit against Marcus Gaede (Defendant), alleging: (1) defamation per se; (2) intentional infliction of emotional distress; and (3) negligent infliction of emotional distress.

            On 10/24/2024, Defendant demurred to Plaintiff’s Complaint.

            In lieu of an opposition, Plaintiff filed a first amended complaint (FAC).

            Accordingly, Defendant’s demurrer is moot.      

It is so ordered.
