TENTATIVE RULING

Defendants’ demurrer is MOOT. Defendants’ motion to strike is MOOT.

            On 11/18/2024, Plaintiff Obadiah Swaffer (Plaintiff) filed suit against Biomat USA, Inc., Grifols USA, Inc., Grifols USA, LLC, and Grifols Worldwide Operations USA (collectively, Defendants), alleging: (1) negligence; (2) negligent misrepresentation; (3) defamation; (4) tortious interference; (5) breach of contract; (6) violation of privacy rights; (7) declaratory judgment; (8) violation of Business and Professions Code section 17200.

            On 12/18/2024, Defendants demurred to Plaintiff’s first, second, fourth, fifth, sixth, seventh, and eighth causes of action.  Defendants also moved to strike portions of Plaintiff’s Complaint.

            On 1/10/2025, Plaintiff filed a first amended complaint (FAC) lieu of an opposition. Accordingly, Defendants’ demurrer is moot, as is the motion to strike.

It is so ordered.
