The Court GRANTS the motion of Defendant Guy F.
Atkinson Construction, LLC (“Defendant”) in part as set forth below. The Court also CONTINUES this hearing to March
11, 2025 at 8:30 am to further consider Defendant’s request for terminating
sanctions.
The Court finds that Plaintiff
Anthony Pena has failed to comply with the Court’s order of September 24, 2024.
Within five court days, Plaintiff
must come into compliance with the Court’s September 24, 2024 order. Specifically, Plaintiff must (a) serve
responses, without objections, to Defendant’s Form Interrogatories-General Set
One; (b) serve responses, without objections, to Defendant’s Form
Interrogatories-Employment Law, Set One; and (c) serve responses, without
objection, to Defendant’s Requests for Production of Documents, Set One.
Plaintiff also shall pay sanctions
of $1,500 directly to Defendant’s counsel within 15 calendar days of this
order.
The Court admonishes Plaintiff to
comply with all court orders. If
Plaintiff fails to do so, the Court may issue terminating sanctions at the next
hearing.
Defendant shall give notice.
