TENTATIVE RULING

The Court has received the Court of Appeal opinion in related Case No. 21STCV40709 (the “Prior Action”).  There is a case management conference in the Prior Action set on today’s calendar.

If all parties agree that this case should be stayed pending the outcome of the Prior Action, the Court will discuss with the parties the timing and logistics of such a stay. 

If the parties are not in agreement about a stay, the Court CONTINUES the hearing on this demurrer to June 11, 2024 at 8:30 a.m. The Court orders that the parties file additional briefing on the following issues: (1) whether this action should be stayed in light of the Court of Appeal’s decision in the Prior Action; and (2) any preclusive effect that Court of Appeal’s decision in the Prior Action has on Plaintiff’s claims in this case.

Defendant shall file a five-page brief on these issues by May 1, 2024. Plaintiff shall file a five-page brief by May 15, 2024.
