Defendant TBC, L.P. (“TBC”) (TBC states that it was
erroneously sued as “The Bicycle Casino, Inc.”) moves the Court for an order
compelling Plaintiff George Rahme (“Plaintiff”) to arbitrate his claims against
TBC and staying this action.
The Court issues no tentative. The Court requests that the parties address
the following:
1.
Does Plaintiff contend that he did not sign the
arbitration agreement, or that he did sign the agreement but his execution of
the agreement was not “knowing.”
2.
What is the effect of the following sentence in the 2018
arbitration agreement: “I and the Company further agree that there will be no
right or authority for any dispute to be brought, heard, or arbitrated as a
private attorney general representative action (“Private Attorney General
Waiver”).”
