ANALYSIS:
I.
Background
On April 18, 2022, Petitioner Michael Oddenino filed a
Petition for Declaratory Relief (“Petition”) requesting the Court to enter a
judgment confirming his a) ancestral lineage, b) identity and identities of his
ancestors and immediate family, c) facts relating to Petitioner, his ancestors,
and immediate family, and d) his relationship to the individuals in the
Petition. (Pet. p. 4.)
On
May 9, 2022, Petitioner filed an Ex Parte Application to request that the Court
enter judgment to confirm these facts so that Petitioner may apply for dual
Italian citizenship. On May 10, 2022,
the Court denied Petitioner’s Ex Parte Application and ordered the entire
action reclassified as a civil unlimited jurisdiction case.
On
May 11, 2022, Petitioner requested dismissal of the entire action and on the
same day, the Court entered dismissal as requested. (5-11-22 Request for Dismissal.)
II.
Legal
Standard
Code of Civil Procedure § 1060
provides that a person may bring an action for declaratory relief if he or she
“desires a declaration of his or her rights or duties with respect to another.” To state a declaratory relief claim, the
plaintiff must allege a proper subject of declaratory relief and an actual
controversy involving justiciable questions relating to the party’s rights or
obligations. (See Jolley v.
Chase Home Finance, LLC (2013) 213 Cal.App.4th 872, 909.)
III.
Discussion
On May 11, 2022, the entire action was dismissed. (5-11-22 Request for Dismissal.) Thus, the Petition is MOOT.

For the foregoing reasons, Petitioner
Michael Louis Oddenino’s Petition is MOOT.
