ANALYSIS:

 

I.                Background & Discussion

 

On July 6, 2022, Plaintiff Reno Hardware & Supply, Inc. (“Plaintiff”) filed an action against Defendants Luna Construction Management, LLC (“Luna”), AB Capital Holdings I, LLC, aka AB Capital Holdings, Inc. (“AB”), FCI Lender Services, Inc. (“FCI”), Wesco Insurance Company (“Wesco”), Joshua R. Pukini (“Pukini”), and Edmund Velasquez, Jr. (“Velasquez Jr.”) for eight different causes of action.  Defendant FCI was sued for the seventh cause of action “to enforce private works stop notice.”

 

On September 22, 2022, Defendant FCI filed Counsel Stoltzman Jr.’s Declaration pursuant to Code of Civil Procedure § 430.41, for an automatic 30-day extension to file a responsive pleading.  On October 21, 2022, Defendant FCI filed an Answer.

 

On November 23, 2022, Defendant FCI filed the instant Motion for Judgment on the Pleadings (“Motion”) and Request for Judicial Notice (“RJN”).  No opposition was filed.

 

On February 22, 2023, pursuant to Plaintiff’s request, the Court dismissed Defendant FCI without prejudice.  (2-21-23 Request for Dismissal.)

 

Accordingly, Defendant FCI’s Motion for Judgment on the Pleadings is PLACED OFF CALENDAR AS MOOT.

 

II.              Conclusion & Order

 

For the foregoing reasons,

 

Defendant FCI Lender Services, Inc.’s Motion for Judgment on the Pleadings is PLACED OFF CALENDAR AS MOOT.
