ANALYSIS:
I.
Background
On December 8, 2011, Plaintiff State
Farm Mutual Automobile Insurance Company (“State Farm” or “Plaintiff”) filed a
complaint against Defendant Santonio Marquis Bullock.
On June 8, 2012, Default Judgment
was entered against Defendant.
On May 16, 2022, Judgment Creditor
and Plaintiff State Farm filed an Application for and Renewal of Judgment,
which was granted on May 18, 2022.

On July 12, 2022, Defendant filed
the instant Motion to Vacate Judgment.
On September 22, 2022, the Court
noted that the hearing on the Motion had not been properly scheduled for a
hearing and, on its own motion, scheduled the hearing for October 17,
2022. (9-22-22 Minute Order.)
On October 4, 2022, Defendant filed
a Notice of Errata and an Amended Motion to Set Aside Default and Default
Judgment, and Quash Service of Summons (“Motion”).
No opposition has been filed.
II.
Legal Standard & Discussion
As a preliminary
matter, the Court notes that the Amended Motion was filed eight (8) court days
before the hearing, instead of the required sixteen (16) court days. (Code of Civ. Proc. § 1005(b).) Furthermore, since it was served on the
Plaintiff by mail, it should have been served sixteen (16) court days and an
additional five (5) days before the scheduled hearing. (Ibid.)
Plaintiff has not
filed an opposition to the Motion, and it is not clear if it has received the
moving papers. For this reason, the Court
CONTINUES the hearing on the Motion to allow Plaintiff time to receive the
moving papers and file an opposition.

For the foregoing reasons,
The Motion to Set Aside/Vacate
Default and Default Judgment filed by Defendant Santonio Marquis Block is
CONTINUED to NOVEMBER 14, 2022 at 10:00 a.m. in Department 25 at Spring Street
