Plaintiffs have filed four discovery motions, originally calendared for May 24, 2024. Counsel for plaintiff appeared ex parte on February 28, 2024 to advance the hearings. Defendant Subaru of America, Inc.
opposed the ex parte, arguing, in part that the discovery was 'stale' based on the age of the discovery.
At ex parte, the Court advanced the hearings to March 8, 2024. No new Notices for the motions have been filed. The Court has received Oppositions from Defendant Subaru.
Based on the Oppositions received, the Subaru of America has responded to the discovery by filing verified responses, including responses to the Requests for Admissions. Based on the representation that responses have been received the motions to compel further responses and the motion that requests for admissions be deemed admitted are moot.
No sanctions have been noticed and none are ordered.
