Defendants' Motion to Conduct a Mental Examination of Plaintiff is GRANTED. Because Mr. Trevino Valdovinos has placed his mental condition in controversy, Code of Civil Procedure § 2032.020 authorizes a mental examination here. The Court is prepared to endorse the order submitted. However, with respect to audio recording, the Court will allow audio recording with the exception of the Raven, Woodcock, and/or SIRS-2 diagnostic test(s) to the extent they are administered. Access to any audio recording is limited to only mental health experts and attorneys on this case unless it becomes necessary to present to the jury at the time of trial, with no copies made, and with the audio recordings destroyed at the conclusion of this matter. Defendants are to prepare an order that incorporates these changes regarding audio recording.
