Plaintiff's motion to extend discovery period until October 27, 2023 is DENIED.

In Plaintiff's moving papers Plaintiff fails to provide any facts, argument or evidence to support Plaintiff's motion. Based on Defendants Gabriel Jebb and Air California Adventure, Inc.'s objection, it appears Plaintiff served a reply. However, there is no record in the court file of Plaintiff having filed a reply. The court did receive a courtesy copy of Plaintiff's reply, but there is no record of this reply having been filed with the court. Even if the court were to consider Plaintiff's reply, the result would not change. In Plaintiff's reply, it appears Plaintiff seeks to propound requests for production of documents on Defendants. As Plaintiff raises this argument for the first time in reply, Defendants have not had an opportunity to respond. Moreover, Plaintiff provides no explanation as to why such requests for production were not propounded during the discovery period in this case. The court finds such circumstances do not support an extension of the discovery period. The court exercises its discretion against allowing the relief Plaintiff seeks.

If this tentative ruling is confirmed the Minute Order will be the final order of the court and the parties shall not submit any further order on this motion.
