Defendant San Diego Unified Port District's unopposed demurrer to Plaintiff's complaint is SUSTAINED.
The court finds, as pled, the complaint fails to allege facts sufficient to support a finding of compliance with the requirements of the Government Claims Act [Government Code § 810, et. seq.]. Absent such allegations all of Plaintiff's claims fail. Government Code § 645.4. See also, City of Stockton v. Superior Court (2007) 42 Cal.4th 730, 738.
As this is the first pleading challenge, the court allows Plaintiff 30 days leave to amend.
If this tentative ruling is confirmed the Minute Order will be the final order of the court and the parties shall not submit any further order on this motion.
