On July 25, 2023, Plaintiff, Dolores Cauinian Tudela, filed this
motion to continue the trial date to March 8, 2024, and to set all discovery
and motion cut-off dates to the new trial date.
Plaintiff argues good cause exists to continue the trial because the
parties need time to complete discovery and to engage in settlement
negotiations. Plaintiff also submits a
stipulation, signed by counsel for the parties and attached as Exhibit B to the
declaration of plaintiff’s counsel, Mike Petikyan, to show that all parties
agree to a trial continuance to at least March 8, 2024, to set all related
deadlines to the new trial date.
Given the
mutual agreement, the Court finds good cause to continue the trial and further,
no prejudice will result from a trial continuance.
Accordingly, the motion to continue trial is GRANTED. The Final Status Conference scheduled for August
25, 2023, is CONTINUED to March 6, 2024 at 10:00 a.m. in Department 27 of the
Spring Street Courthouse, and the Non-Jury Trial scheduled for September 8,
2023 is CONTINUED to March 20, 2024 at 08:30 a.m. in Department 27 of the
Spring Street Courthouse. All discovery
cut-off dates, all pretrial deadlines including discovery, expert, and motion
cut-off dates are set to the new trial date of March 20, 2024.
