MOTION TO CONTINUE TRIAL

MOVING PARTY:                   Defendant Los Angeles World Airports

RESPONDING PARTY:     No opposition

            On July 18, 2023, Defendant, Los Angeles World Airports, filed this motion to continue the trial date, to set all pretrial deadlines to the new trial date, and to continue the date of Defendant’s motion for summary judgment.  Defendant argues good cause exists to continue the trial because the parties have yet to participate in mediation and to complete discovery in connection with Defendant’s summary judgment motion and in advance of trial.  Defendant also submits a stipulation, signed by all parties and attached as Exhibit A to the declaration of defense counsel, Michael A. Marzban, to show that all parties agree to a trial continuance to at least February 8, 2024, to set all pretrial deadlines to the proposed trial date, and to continue the hearing date for Defendant’s summary judgment motion to at least November 6, 2023.  This is the third request for a trial continuance.

            Given the mutual agreement as to all requests, the Court finds good cause to continue the trial and Defendant’s summary judgment motion.  Additionally, no prejudice will result from a trial continuance given the agreement.

Accordingly, the motion to continue trial is GRANTED.  Defendant Los Angeles World Airports’ motion for summary judgment is continued to November 7, 2023 at 1:30 p.m.  The Final Status Conference scheduled for September 20, 2023, is CONTINUED to March 5, 2024 at 10:00 a.m. in Department 27 of the Spring Street Courthouse, and the Non-Jury Trial scheduled for October 4, 2023 is CONTINUED to March 19, 2024 at 08:30 a.m. in Department 27 of the Spring Street Courthouse.  All discovery cut-off dates, all pretrial deadlines including discovery, expert, and motion cut-off dates are set to the new trial date of March 19, 2024.
