MOTION TO LIFT STAY AND REINSTATE ACTION IN THIS COURT

MOVING PARTY:               Plaintiff Cassondra Hollman

Plaintiff Cassondra Hollman brings this PAGA action, individually and on behalf of all others similarly situated, against defendants, AYA Healthcare, Inc. d/b/a Aya Healthcare Staffing, Inc. (“Aya”), Pacific Gardens Medical Center, LLC (“Pacific Gardens”), and Pacifica of the Valley Corporation d/b/a PHV Pacifica Hospital of the Valley (“PHV”), alleging various wage and labor violations.

            On September 1, 2022, the court granted Aya’s motion to compel arbitration of Plaintiff’s individual PAGA claims and denied the motion as to Plaintiff’s non-individual PAGA claims.  The action was stayed pending arbitration. 

            On April 1, 2025, Plaintiff filed this motion to lift the stay and reinstate the action as to Plaintiff’s non-individual PAGA claims.  Plaintiff represents that arbitration has concluded.

On May 2, 2025, Aya filed a notice of non-opposition to Plaintiff’s motion.  On the same day, Pacific Gardens and PHV also filed a notice of non-opposition to Plaintiff’s motion.

            Given there is no dispute arbitration of Plaintiff’s individual PAGA claims has concluded, the court orders the stay lifted.  The case is reinstated. 

            The court sets a Case Management Conference and a Trial Setting Conference for June 16, 2025 at 9:00 a.m.
