Tentative Ruling
Judge Kerry Bensinger, Department 27
HEARING DATE: May
11, 2023 TRIAL
DATE: December 6, 2023
CASE: Douglas Gonzalez v. Roger Trucking, et al.
CASE NO.: 22STCV03053
MOTION
TO BE RELIEVED AS COUNSEL
MOVING PARTY: Cassandra
E. Griffith, Mission Personal Injury Lawyers
RESPONDING PARTY: No opposition
On January 5, 2023, Plaintiff Douglas Gonzalez’s counsel,
Cassandra E. Griffith (“Counsel”), filed a Motion to be Relieved as Counsel. The Court continued the motion to allow
Counsel to correct deficiencies on the declaration and proposed order. Specifically, the declaration and proposed
order did not notify Plaintiff of all future hearings nor the place of the
future hearings.
On February 9, 2023, Counsel filed a revised Motion to be
Relieved as Counsel. The Court continued
the motion to allow Counsel to correct deficiencies on the declaration and
proposed order. Specifically, the
declaration and proposed order did not notify Plaintiff of all future hearings in
this matter.
On April 11, 2023, Counsel filed this Motion to be Relieved
as Counsel. The motion was heard on May
11, 2023. The Court continued the motion
because Counsel had not listed all future hearings in her declaration, and the
proposed order did not include Defendant’s Motion to Compel Deposition of
Plaintiff Douglas Gonzalez for September 19, 2023 or the Final Status
Conference on November 22, 2023.
On May 11, 2023, Counsel filed an amended Motion and
supporting documents. Upon review of the
amended Motion, the Court finds Counsel has corrected the deficiencies noted in
the May 11, 2023 order.
Accordingly, the unopposed Motion is GRANTED and effective
upon filing a proof of service showing service of this Order on Plaintiff.¿
Moving party to give notice.
