On June 28, 2023, Plaintiff, Frank Bledsoe, filed this
motion to continue the trial date and to set all pretrial deadlines to the new
trial date. Plaintiff argues good cause
exists to continue the trial because the parties have yet to complete essential
discovery. Plaintiff also submits a
stipulation, signed by all parties and attached to the declaration of
plaintiff’s counsel, Pavel Krepkiy, to show that all parties agree to a trial continuance
to at least May 28, 2024, and to set all pretrial deadlines to the proposed
trial date. This is the first request
for a trial continuance.
Given the
mutual agreement to continue the trial date and the need to complete discovery,
the Court finds good cause to continue the trial. Additionally, no prejudice will result from a
trial continuance given the agreement.
Accordingly, the motion to continue trial is GRANTED. The Final Status Conference scheduled for October
31, 2023, is CONTINUED to May 14, 2024 at 10:00 a.m. in Department 27 of the
Spring Street Courthouse, and the Non-Jury Trial scheduled for November 14,
2023 is CONTINUED to May 28, 2024 at 08:30 a.m. in Department 27 of the Spring
Street Courthouse. All discovery cut-off
dates, all pretrial deadlines including discovery, expert, and motion cut-off
dates are set to the new trial date of May 28, 2024.
