EXPEDITED PETITIONS TO APPROVE MINOR’S COMPROMISE

I. INTRODUCTION

This is a tenant-landlord dispute between Plaintiffs, Samli Mayorga Gonzalez Saquich, Arnoldo Dario Gomez, Sheccid Gonzalez, Saheera Gomez, and Shahzaadee Gomez, and Defendant, Sunnycrest Canoga LLC, regarding allegedly uninhabitable conditions.

On December 19, 2023, Defendant filed a Notice of Settlement.

Samli Mayorga Gonzalez Saquich now petitions the Court for expedited approval of the following Petitions to Approve Minor’s Compromises:

Claimant Saheera Gomez

Claimant, Saheera Gomez, a minor, by and through her parent and guardian ad litem, Petitioner, Samli Mayorga Gonzalez Saquich, has agreed to release her claims against Defendant in exchange for $5,000. If approved, $1,250 will be used for attorney’s fees and $153.47 will be used for other expenses, leaving a balance of $3,596.53 for Claimant to be paid or delivered to a parent of the minor on the terms and under the conditions specified in Probate Code section 3401-3402.

Court approval is required for all settlements of a minor’s claim. (Probate Code §§ 3500, 3600, et seq.; Code Civ. Proc. § 372.) The petition must be verified and “must contain a full

disclosure of all information that has any bearing on the reasonableness of the compromise, covenant, settlement, or disposition.”¿ (Cal. Rules of Court, rule 7.950.)¿¿

The Court has reviewed the Petition and finds the settlement amount is fair and reasonable, as is the request for attorney’s fees.

Accordingly, Claimant Saheera Gomez’s Petition is GRANTED.

Claimant Shahzaadee Gomez

Claimant, Shahzaadee Gomez, a minor, by and through her parent and guardian ad litem, Petitioner, Samli Mayorga Gonzalez Saquich, has agreed to release her claims against Defendant in exchange for $5,000. If approved, $1,250 will be used for attorney’s fees and $153.47 will be used for other expenses, leaving a balance of $3,596.53 for Claimant to be paid or delivered to a parent of the minor on the terms and under the conditions specified in Probate Code section 3401-3402.
