Plaintiff Dean R. Isaacson seeks to continue the trial date of August 14, 2023, by 75 days and have discovery cut-off dates tethered to the new trial date.  Plaintiff contends he needs additional time to prepare for trial in light of failed settlement negotiations.  

The request is partially moot as the trial date has already been continued to November 27, 2023, via ex parte application.  

The only issue is whether the discovery cut-off dates should be extended.  Defendant Trancas PCH LLC opposes this and points out that the Court, when granting a prior trial continuance, specifically declined to extend the cut-off dates.

On July 14, 2023, the Court also denied Plaintiff's ex parte application seeking to extend the cut-off dates.  Plaintiff contended that Defendant fraudulently induced Plaintiff to sign a stipulation declining to extend the cut-off dates when Plaintiff made clear that he wanted to conduct discovery.

The Court is inclined to deny the request to extend the discovery cut-off dates, but will hear further argument on the issue.
