Plaintiffs Evelyn Gonzalez, Paula Martinez, Giovanni Negrete, Maria Lopez, Alma Negrete, Jose Luis Lopez, and Jose Ignacio Lopez move for an order substituting Plaintiff Jose Luis Lopez in place of Plaintiff Alma Negrete pursuant to Code of Civil Procedure § 377.31 on the grounds that Negrete passed away on January 31, 2022.  Plaintiffs provide that “Jose Luis Lopez is the successor in interest as defined in Code of Civil Procedure § 377.11 and succeeds to the decedent’s interest in the above-entitled proceeding.”  Luis is Negrete’s husband.

Because the requirements of Code Civ. Proc. § 377.32 have been met (Luis Decl. ¶¶ 1-8), the Motion is granted.  (Code Civ. Proc. §§ 377.31.)
