Plaintiff Cindy Perez seeks to compel Defendant Ideal Face & Body to provide document responses to her requests for production, set two. Plaintiff also seeks to compel a deposition of Defendant’s PMK.
The Motion is denied as moot as to the requests for production because it seems Defendant served responses on August 24, 2022. (Kruger Decl., Exhibit F.)
With regard to the PMK deposition, the Court finds credible the contention that defense counsel did not obtain the deposition notice because it was served on the building’s general receptionist while defense counsel’s office was closed. Therefore, the Motion is denied. The parties are to meet and confer on the issue of a PMK deposition.
As this Motion was actually two separate motions, Plaintiff is ordered to tender an additional filing fee.
