Case Name: Remneff v. Bellatrix Media, Inc., et al.
Case No.: 19STCV15486
Matter: Motion to Compel Further Response
Moving Party: Defendant Maureen Rourke
Responding Party: Plaintiff Melanie Remneff
Notice: OK
Ruling: The Motion is denied.
Moving party to give notice.
If counsel do not submit on the tentative, they are strongly
encouraged to appear by LACourtConnect rather than in person due to the COVID-19 pandemic.
This is an employment action with a defamation cause of action. Defendant Maureen Rourke seeks to compel a further response from Plaintiff Melanie Remneff to her form interrogatory, set two, no. 2.6.
It is not apparent that there was a good faith meet and confer effort before the Motion was filed. (See Code Civ. Proc. § 2030.300.) The Motion was initially filed on December 2, 2022—only one day after Defendant sent a meet and confer email about Plaintiff’s supplemental response. Defendant only gave Plaintiff one day to respond, despite that the Motion deadline was not at issue. This is not a good faith meet and confer effort. Therefore, the Motion is denied. The Court declines to award sanctions.
Moving party to give notice.
If counsel do not submit on the tentative, they are strongly encouraged to appear by LACourtConnect rather than in person due to the COVID-19 pandemic.
