Nissanoff has filed a notice of related cases, seeking to relate the instant case to case nos. 14S03245,  19SMSC03250, 19STSC12264, 20SMSC03165, 20SMSC02014, 20SMSC01241, 20SMCV00776.

The inquiry on a notice of related cases is whether the cases at issue (1) involve the same parties and are based on the same or similar claims; (2) arise from the same or substantially identical transactions, incidents, or events requiring the determination of the same or substantially identical questions of law or fact; (3) involve claims against, title to, possession of, or damages to the same property; or (4) are likely for other reasons to require substantial duplication of judicial resources if heard by different judges.  (Cal. Rules of Court, rule 3.300(a).)

The Court will not relate the subject cases.  First, all of the cases at issue were filed years ago, such that judicial resources have already caused duplication and the benefit of relation has been substantially diminished.

Similarly, the benefit of relating cases is diminished because the notice indicates all but one case has already been disposed of by judgment.  Further, the only pending case (20SMCV00776) is already set for trial in March 2023.

Finally, the benefit of relation is not apparent when the parties have and will have an endless continuum of disputes amongst them, which they have chosen to present as different suits.  (See Joseph Conrad (1899) The Heart of Darkness [“It was written I should be loyal to the nightmare of my choice.”].)
