Hearing Date: April 7, 2023
Case Name: Coreas v. Vista Care Home, Inc.
Case No.: 21STCV35747
Matter: Motions to Compel (2x)
Moving Party: Defendant Vista Care Home, Inc.
Responding Party: Plaintiff Marta Coreas
Notice: OK
Ruling: The Motions to Compel are denied.
Moving party to give notice.
If counsel do not submit on the tentative, they are strongly
encouraged to appear by LACourtConnect rather than in person due to the COVID-19 pandemic.
This is an employment matter. Defendant Vista Care Home, Inc. seeks to compel further responses to its special interrogatories nos. 1-50 and requests for production nos. 125-174.
The requests for production seek documents supporting the responses to special interrogatories. The special interrogatories seek all facts supporting paragraphs 7-106 of the Complaint.
The Court finds this sort of discovery—where facts are requested for each and every paragraph of a pleading—to be abusive, duplicative, and inefficient. Defendant should redraft non-duplicative discovery that actually seeks the evidence needed to defend this case.
Because the interrogatories are improper, the Motions are denied. The Court declines to award sanctions.
Moving party to give notice.
