This is a lawsuit relating to negligence and other improprieties with regard to Plaintiffs’ apartment unit.
Plaintiff Christian Murillo, a minor, by and through his guardian ad litem, Cynthia Zelaya, seeks to settle his claims against Defendants Enrique Trejo and Maria Rangel.
Court approval is required for all settlements of a minor’s claim. (Probate Code §§ 3500, 3600, et seq.; Code of Civ. Proc. § 372.) The Court has reviewed the proposed settlement and finds that it is fair and reasonable. Further, no attorneys’ fees will be collected from the claimant.
However, the proposed order and Petition seek to disburse the settlement funds to the claimant’s guardian. The Court would prefer that the money be deposited in a blocked account. Therefore, the Court will continue the Petition to obtain an updated proposed order indicating a deposit in a blocked account.
