Plaintiff David Williamson seeks to compel responses from Defendant Janik Roskovani as to his requests for admission, special interrogatories, form interrogatories, and requests for production.
Defendant Roskovani contends that responses were served by mail on the same day that Plaintiff’s counsel changed his address, causing confusion.
As responses were served on October 7, 2022, and January 11, 2023 (Tamborelli Decl. ¶¶ 2, 5), the Motion to Compel is denied as moot.
The Court declines to award sanctions.
The Court notes that Plaintiff tendered only one filing fee when the Motion is directed at four forms of discovery. Plaintiff is ordered to tender $180 in additional filing fees within five days or face sanctions.
