Plaintiffs Irene Young and Jesse Chang seek to compel initial responses from Defendant Pacific Plaza Elite-Alhambra Homeowners Association as to their requests for production, set one, and form interrogatories, set one.

Since the filing of the Motions, Defendant served responses to the subject discovery.  Plaintiffs then purported to transform their motions to compel initial responses to motions to compel further responses, by filing an amended notice.

Defendant then served supplemental responses, which Plaintiffs assert are again deficient.

As initial responses have been served, the Motions are denied as moot.  Plaintiffs cannot unilaterally change the character of their motions by filing an amended notice.  The Court’s reservation system clearly shows reservations only to compel initial responses.  Furthermore, supplemental responses would moot any motion to compel further responses.

The Court declines to award any sanctions.
