This is a lemon law action. Plaintiff Charisse Wells seeks to compel further responses from Defendant Jaguar Land Rover North America, LLC as to her requests for production and special interrogatories.
Special Interrogatories
Plaintiff seeks to compel further responses to special interrogatory (“SI”) nos. 10, 23, 24, 45, 46, 51, and 57.
The Motion is granted as to SI nos. 10, 23, 24, 45, 51, and 57. These SIs seek basic information about witnesses and Defenadant’s contentions. Defendant’s answers are either nonresponsive or else assert meritless objections.
The Motion is denied as to SI no. 46, which asks how many repair attempts Defendant was given. The response was four, which is sufficient.
In sum, the Motion is granted in part as set forth above. Further responses are to be served within twenty days.
Requests for Production
Plaintiff seeks to compel further responses to requests for production nos. 17, 31, 37-66, and 72-75.
The Motion is granted as to request no. 17, which seeks, “All DOCUMENTS to include but not limited to manuals, publications, directives and direct dealer notifications or advisements regarding, pertaining, or relating to handling warranty repairs on the SUBJECT VEHICLE.” Defendant’s response inappropriately relates only to select documents.
The Motion is denied as to request no. 31, which seeks, “All DOCUMENTS relating to the Customer Call Center, including but not limited to, all flow charts, processes, and/or scripts.” This request is overbroad and overburdensome.
The Motion is also denied as to request nos. 37-66, which seek documents relating to individual vehicles other than the subject vehicle. These requests are far overbroad and overburdensome.
The Motion is granted as to request nos. 72 and 73, which seek all TSBs and recalls for the subject vehicle. This is relevant information.
The Motion is also granted as to request nos. 74-75, which seek all documents regarding repair and diagnostic procedures considered for the subject vehicle. Again, this is basic and relevant information.
In sum, the Motion is granted in part as set forth above. Further responses are to be served within twenty days.
