Judge: Kevin C. Brazile, Case: 23STCV07125, Date: 2023-05-26 Tentative Ruling
Hearing Date: May 26, 2023
Case Name: West Adams Heritage Association v. City of Los Angeles, et al.
Case No.: 20STCP00916
Matter: Non-Appearance Case Review Re: Notice of Related Cases
Ruling: The Court will not relate the subject cases.
Petitioners to give notice.
On March 4, 2020, West Adams Heritage Association and Adams Severance Coalition filed a Petition for Writ of Mandate that “challenges the City of Los Angeles’ [ ] failure to comply with the California Environmental Quality Act [ ], State Planning and Zoning Law and the City’s Municipal Code in approving a 102-unit student housing development along the historic West Adams Boulevard.”
On February 4, 2022, the Court entered judgment in favor of Respondent City of Los Angeles and Real Parties in Interest Robert Champion, Champion Real Estate Company, and 806 West Adams Property, LLC and against Petitioners West Adams Heritage Association and Adams Severance Coalition.
Petitioners have appealed the Judgment.
Petitioners have also filed a notice of related cases as to case nos. 23STCP01363 and 22STCP02210.
The inquiry on a notice of related cases is whether the cases at issue (1) involve the same parties and are based on the same or similar claims; (2) arise from the same or substantially identical transactions, incidents, or events requiring the determination of the same or substantially identical questions of law or fact; (3) involve claims against, title to, possession of, or damages to the same property; or (4) are likely for other reasons to require substantial duplication of judicial resources if heard by different judges. (Cal. Rules of Court, rule 3.300(a).)
The Court will not relate the subject cases due to factual variance; specifically, 23STCP01363 relates to a different 52-unit development, and, while 22STCP02210 pertains to the same project as the instant case, it relates to a somewhat different issue, challenging “the City’s Redevelopment Plan Project Compliance Review, which was improperly segmented from prior environmental review and approvals.”
Petitioners to give notice.
If counsel do not submit on the tentative, they are strongly encouraged to appear by LACourtConnect rather than in person due to the COVID-19 pandemic.
