This is a lemon law action.  Plaintiffs John Bonilla and Nicole Davilla now seek to compel a PMK deposition for Defendant General Motors, LLC. 

Defendant has “agreed to produce a PMK for deposition on Categories 1 and 5-11 at a mutually agreed upon time and place. Thus, the only categories at issue are Category Nos. 2-4 and 12.”

Plaintiffs’ separate statement does not include category no. 12, so the only matters at issue are category nos. 2-4.

Category no. 2 is “Defendant’s warranty policies, procedures, and guidelines.”  The Motion is granted as to this category, but only to the extent that the information is applicable to the subject vehicle.

Category nos. 3-4 relate to procedures for dealing with complaints and ensuring compliance with the Song-Beverly Act.  A PMK must be produced for these categories; however, the PMK need not have specific knowledge about individual vehicles other than the subject vehicle.  

The Motion is granted.  The deposition is to take place within 30 days.
