On September 4, 2024, Plaintiff University of Southern California (“USC”) filed the operative First Amended Complaint (“FAC”) against Defendant Aluminum Precision Products, Inc.
On October 24, 2024, USC attempted to file a Second Amended Complaint (“SAC”), but that pleading was rejected because USC never sought leave of Court for the amendment.
Defendant now demurs to the SAC for failure to state sufficient facts.
Because the SAC is not a valid pleading, the Demurrer will not be considered. The Demurrer is placed off calendar.
The time to file a demurrer or other response to the FAC is hereby tolled. The responsive pleading is due within 30 days. Also, Plaintiff can move for leave to file the SAC.
