Defendant’s Motion to Compel Further Responses to Requests for Production of Documents, Set One and Request for Monetary Sanctions
Defendant North Orange County Community College District’s motion to compel plaintiff Irma Bonilla to serve further responses to defendant’s Requests for Production of Documents, Set One, Nos. 4, 6-10, 12-14, 16-18, 26 is GRANTED.
Code of Civil Procedure section 2031.220 states: “A statement that the party to whom a demand for inspection, copying, testing, or sampling has been directed will comply with the particular demand shall state that the production. . . will be allowed either in whole or in part, and that all documents or things in the demanded category that are in the possession, custody, or control of that party and to which no objection is being made will be included in the production.” (Emphasis added.)
Plaintiff’s responses fail to comply with section 2031.220. An objection incorporated into a response does not take the place of a code compliant statement of compliance.
Plaintiff is ORDERED to provide further responses to request nos. 4, 6-10, 12-14, 16-18, 26 within 20 days.
Plaintiff and her counsel, jointly and severally, are ORDERED to pay $1,462.50 in sanctions to Defendant’s counsel within 20 days for misuse of the discovery process.
