Defendant Super Center Concepts, Inc.’s Motion for an Order Compelling Further Response to Request for Production of Documents No. 26 by Plaintiff Carmen Saragoza; and for Monetary Sanctions
Defendant Super Center Concepts, Inc.’s motion to compel Plaintiff Carmen Saragoza to serve a verified amended response to Request for Production of Documents No. 26 and produce responsive documents is DENIED.
Defendant contends the documents sought by Request No. 26 are relevant based on Qaadir v. Figueroa (2021) 67 Cal.App.5th 790, 807-808 (Qaadir), where the court found evidence plaintiff’s attorney referred him to lien-physicians was relevant to the issue of reasonable value of lien-physicians’ medical care because it may show bias or financial incentive on part of lien-physicians to inflate medical bills.
Defendant has shown good cause exists to compel referral evidence from lien-physicians. However, the Request here seeks far more than referral evidence. It is overbroad in requesting “all writings” Plaintiff’s attorney sent or received about Plaintiff’s treatment with any healthcare provider. Defendant has not shown all writings from all providers are relevant.
