[TENTATIVE] ORDER RE MOTIONS IN LIMINE

Plaintiffs’ MIL No. 1

            Plaintiffs move to exclude reference to the complaint and former defendants no longer in this case.  Pursuant to the July 8, 2022 CMO, this motion regarding the complaint is made deemed and granted except not to affect any allocation of fault under Proposition 51 and is deemed made and denied as to the liability of tortfeasors not present at trial.

            The motion is granted except not to affect any allocation of fault under Proposition 51 and denied as to the liability of tortfeasors not present at trial.

Plaintiffs’ MIL No. 2

            Plaintiffs seek to exclude reference to bankrupt entities and bankruptcy trusts.  Pursuant to the July 8, 2022 CMO, this motion is deemed made and granted.  Defendant argues that claims forms contain party admissions.  To the extent Defendant can prove that a document is a party admission and to the extent the document can be redacted to remove references to bankruptcy and bankruptcy trusts, the motion is denied.

            The motion is granted in part and denied in part.

            The moving party is to give notice.
