[TENTATIVE] ORDER RE MOTION TO QUASH
Plaintiff
David Rody served Defendant Signify North America Corporation with the
complaint and summons on July 14, 2021.
Defendant did not file an answer.
Instead, on December 21, 2022, Defendant filed a motion to quash the
service of summons for lack of personal jurisdiction.
This
motion is defective. Under Code of Civil
Procedure section 418.10, subdivision (a), a defendant may file a motion to
quash service of summons for lack of personal jurisdiction “on or before the
last day of his or her time to plead or within any further time that the court
may for good cause allow.” Defendant
waited seventeen months after being served to file its motion, did not request
further time to file the motion, and did not show good cause for waiting so
long.
The
motion is denied.
The
moving party is to give notice.
