[TENTATIVE] ORDER RE MOTION TO BE RELIEVED
Nancy Williams and Brayton Purcell,
attorneys of record for Plaintiffs Melissa Kugan and Lorraine Reynolds, seek to
be relieved as counsel on the grounds of irreconcilable differences.
Absent a showing of resulting
prejudice, an attorney’s request for withdrawal should be granted. (People
v. Prince (1968) 268 Cal.App.2d 398, 406.)
Counsel’s motion complies with California Rules of Court, Rule 3.1362,
except there is no proof of service showing the motion papers were served on
Plaintiffs and the other parties.
No party opposed the motion. Because no trial has been set, no prejudice
will result from granting the motion. But
because no proof of service was filed, the motion is denied.
The moving party is to give notice.
