Plaintiff/Judgment Debtor Stephen H. Bennett’s motion to tax costs is CONTINUED TO 2/16/23 at 2PM.

Judgment Creditor Coastline JX Holdings to file and serve a supplemental brief at least 16 court days before the hearing date to address whether the appellate fees it seeks in its memorandum of costs under Code of Civil Procedure section 685.040 [ROA 1757] are permitted under Conservatorship of McQueen (2014) 59 Cal.4th 602.  Concurrently with its supplemental brief, Coastline is to file and serve a supplemental declaration to segregate the billing statements by Frandzel Robins Bloom & Casto between the trial work and the appellate work it performed in:  (1) the Letwak & Bennett motion to set aside litigation and (2) the Bennett retirement plan litigation. 

Plaintiff may file and serve a supplemental response to Coastline’s supplemental brief and declaration at least 9 court days before the hearing date. 

No further briefing will be allowed.
