Claim of Exemption – Levy

The hearing on the instant claim of exemption is CONTINUED to 12/1/22 at 2PM, for lack of proper service.

The Notice of Hearing indicates that service was completed at: 400 Continental Blvd. 6^th Floor, El Segundo, CA 92701. (ROA No. 60). However, the correct zip code for Judgment Debtor’s Counsel is 90245. (See ROA No. 66). “In the absence of proof notice was actually received, [Judgment Creditor’s] failure to use the correct zip code invalidates what would have otherwise been sufficient notice.” (Moghaddam v. Bone (2006) 142 Cal.App.4^th 283, 288).

Judgment Creditor is ordered to provide notice of the continued hearing date to Judgment Debtor and the levying officer, no later than October 28, 2022. Similarly, Judgment Creditor shall file a Proof of Service, demonstrating compliance with this order, no later than October 31, 2022.
