Judgment Creditor/Plaintiff Crown Valley Holdings, LLC’s motion to amend the Judgment to add Brian Roche as an additional Judgment Debtor is continued to 8/4/22 at 2PM.

 

Plaintiff filed a proof of personal service of the motion on Brian Roche; however, it was not made on the mandatory Judicial Council form.

 

The Court must have jurisdiction over the judgment debtor's alter ego in order to enter a valid judgment against the alter ego, which typically is accomplished by service of process. (See Milrot v. Stamper Medical Corp. (1996) 44 Cal.App.4th 182, 186; see also Cal. Prac. Guide Enf. J. & Debt Ch. 6G-15 at ¶ 6:1575.1.)   Code Civ. Proc., 417.10(f) states: “All proof of personal service shall be made on a form adopted by the Judicial Council.”  

As a result, the Court continues the hearing to allow Plaintiff to file an amended proof of service no later than 5 Court days before the continued hearing date.

 

Plaintiff shall give notice.
