(P) Petition for Change of Gender and/or Name

Petitioner Robert Adrian Esacatel (“Petitioner”) seeks an order allowing Petitioner to add Petitioner’s middle name to the forms submitted in support of the petition and for a new order that includes Petitioner’s middle name.

On 4/8/2022, the Court issued a decree changing Petitioner’s name to Robyn Escatel, gender to female, and that a new birth certificate be issued. 

Petitioner’s initial Petition for Change of Name, Recognition of Change of Gender, and Issuance of New Birth Certificate and Order to Show Cause for Change of Name to Conform to Gender Identity included Petitioner’s middle name “Adrian.”  It appears the Decree Changing Name and Order Recognizing Change of Gender and for Issuance of New Birth Certificate inadvertently omitted Petitioner’s middle name. 

Petitioner’s unopposed motion is granted.  The Court exercises its discretion under Code of Civil Procedure section 473, subdivision (d) to correct Petitioner’s clerical error in omitting Petitioner’s middle name “Adrian” from the proposed decree.

The Court will issue an amended decree that includes Petitioner’s middle name, a copy of which was attached to Petitioner’s unopposed motion.
