Petitioner Sequoia Companies, LLC’s First Amended Petition for approval of transfer of structured settlement payment rights is denied without prejudice.

Petitioner has not sufficiently demonstrated that the terms of the transfer are fair, reasonable and in the Payee’s best interest.  The quotient is below 50% and Payee can obtain more favorable terms for less future payments from BIFCO, LLC, under the counter-petition filed by it.

Petitioner BIFCO, LLC’s petition for approval of transfer of structured settlement payment rights is continued to 9/8/22 at 2PM to comply with Ins. Code §10139.5(f)(2), which requires the petition to be filed and served 20 days before the hearing.

The court notes that under BIFCO’s petition Payee will transfer the same payments but under more favorable terms than those provided for in Sequoia Companies’ petition.  The quotient is 73.41%.  Further, Payee has established her need of funds to pay for urgently needed dental surgery.
