Motion to Compel Arbitration

On 10/20/22, the court granted Petitioner Financial Indemnity Company’s Petition to compel Respondent David Pham to arbitrate his uninsured motorist claim resulting from an accident with third-party driver, Ly Tran on 6/8/18. (ROA 36.)

The court continued the matter and ordered parties to provide a list of names of arbitrators. It does not appear anything was filed after 10/20/22.

Appointing an arbitrator in a UM case is governed by CCP § 1281.6. (Ins. C. § 11580.2(f); see Gordon v. G.R.O.U.P., Inc. (1996) 49 CA4th 998, 1005.)

The court nominates the following five persons to serve as the arbitrator in this matter:

1. Dennis Choate, a retired Orange County Superior Court Judge with ADR;

2. Robert J. Polis, a retired Orange County Superior Court Judge with Judicate West; and,

3. Debra Dominski, an independent mediator.

4. Thierry Patrick Colaw, a retired Orange County Superior Court Judge with Judicate West

5. Andrew J. Guilford, a retired Federal District Court Judge with Judicate West

The parties shall have 5 days to jointly select an arbitrator from this list.  If the court is not notified within 5 days of the hearing date of 12/8/22 that the parties have jointly selected an arbitrator, the court will select one of the above-names and provide notice of the same.
