The Court notes that, as disclosed in the petition and supporting papers, this will be the third transaction that the payee, Nadia Mendez, has completed within the last two years. Nevertheless, because Ms. Mendez has sworn under oath that she is currently experiencing a “financial hardship” and “will use the money received . . . to pay for school tuition,” the Court is inclined to find that the subject transfer is “fair and reasonable” and in the “best interest” of the payee. In reaching this conclusion, the Court has also considered, among other factors, the terms of the transaction, payee’s current financial situation (i.e., that she is unemployed), the payee’s ability to understand the transfer, the payee’s lack of spousal or dependent support obligations, and that the settlement payments were not intended for future medical or living expenses. (Ins. Code § 10139.5(a)-(d).) Lastly, Petitioner has complied with all statutory requirements, including notice and the requisite disclosures.
Petitioner shall give notice of the ruling.
