Petition For An Order Modifying Voting Requirments to Amend CC&RS

Petitioner Beacon Hill Terrace Condominium Homeowners Association moves for an order pursuant to Corp. Code, § 7515 to modify the voting requirements to amend its governing documents.

The Court will set a hearing date and briefing schedule for the Petition upon Petitioner’s filing of an amended Proposed Order.

Given that the moving papers will only be made available to members upon request, Petitioner shall include a paragraph summary in the amended proposed order that summarizes the purpose of the Petition in layman’s terms. 

In addition, Petitioner is ordered to provide an additional and alternate method for service of any oppositions (e.g., via a specified email address, and/or U.S. Mail), so that members are not obligated to rely on service via facsimile. 

Petitioner shall file its amended proposed order, no later than Friday, May 26, 2023.
