Motion to Set Aside/Vacate Judgment

The Labor Commissioner seeks an order setting aside the judgment entered on 4/8/2022 against defendants Luv 2 Operate LLC and Luv 2 Play Leesburg LLC. 

The Labor Commissioner showed the judgment was entered as a result of a factual mistake.  (Norris Decl., ¶ 3.)  Accordingly, the unopposed motion is granted.  (Code Civ. Proc., § 473, subd. (b).)  The 4/8/2022 judgment is hereby vacated, and this proceeding is dismissed without prejudice.   

Labor Commissioner shall give notice to all parties.
