Motion - Other (For Approval of Transfer of Structured Settlement Payment Rights)

Petitioner Sequoia Companies, LLC’s (“Petitioner”) First Amended Petition for approval of transfer of structured settlement payment rights is denied without prejudice.

Petitioner has not sufficiently demonstrated that the terms of the transfer are fair, reasonable and in the Payee’s best interest.  The quotient is below 50%, at only 44.56%.  Furthermore, Payee has not provided any details as to whether she has sources of income aside from her structured settlement payments.  Payee’s overall financial situation is unclear, such that the Court is unable to conclude whether she is facing a hardship situation, or conversely, whether her resulting remaining structured settlement payments will be sufficient to support herself and her two dependents. 

Further interested party BHLN suggests that it is prepared to offer the relief sought by payee but on more favorable financial terms. 

Although not a basis for denial the Court notes that there is no court order or other justification for using a pseudonym rather than the payee’s full name.  Any future petitions shall be in the full name of the real party in interest.
